What Are the Treaty Countries?

The treaty countries eligible for the E-2 Investor Visa are countries that have a trade treaty with the US. These countries include the following:

How to Extend Your E-2 Investor Visa?

As long as you continue to meet the requirements of the program, you can extend your E-2 Visa for 2 years indefinitely. However, always make sure to apply before your current visa expires. The process of applying for an E-2 Visa extension is still as lengthy and time-consuming as making your initial application. You can apply for an extension online at the US Citizenship and Immigration Services (USCIS) website. You will have to:

  • Complete Form DS-160, the online visa application
  • Login to the Visa Appointment Service website and pay the required application fee and arrange for the delivery of your passport with the visa stamp once the process is complete
  • Attend an interview appointment if required by the USCIS

You will also be required to submit the following documents to demonstrate your eligibility for the E-2 Visa program:

Cover Letter: 

This letter will highlight your enterprise and personal information to prove that the following circumstances are valid:

  • A trade treaty exists between the US and your home country
  • You are a national of the treaty country
  • You have invested in the US or are in the process of investing
  • Your enterprise is for-profit, operational and bonafide
  • Your investment is still deemed substantial
  • Your investment earns more than just a living for you and your family
  • You are still directly involved in the operations of your enterprise
  • You still intend to leave the US once your visa expires

Completed Forms and Documents: 

As mentioned above, a completed Form DS-160 is required to apply for an extension of the E-2 Visa. In addition to that, the following documents will be required:

  • A copy of the receipt showing that you have paid the MRV fee
  • A detailed letter about your position in the enterprise which contains the following: 
  • Details about the company
  • Your role and title in the company
  • The salary, benefits and other allowances received by you from the company
  • Your qualifications for the position
  • Contact information of the company
  • A letter of agreement between you and your legal representative if required
  • Evidence of any new investments in the company

Evidence of new investments is required if you no longer operate the same business that you were initially approved for. It also applies if you have purchased any additional business. The only way to secure an extension is to make sure that you meet all the requirements for the E-2 Investor program and your investment is still viable.
